The website kinthia.com (Kinthia) is operated by the company Arfooo, located at 40 rue du Val de Glatigny, 95280 Jouy-le-Moutier, France. The terms “we”, “our”, “us”, “Site”, “Seller” and “Services” refer to Kinthia.
By accessing this site or purchasing a product, you agree to comply with these General Terms and Conditions of Sale (“Terms”). If you do not agree, please do not use this site.

These Terms apply to all distance sales, without this list being exhaustive: goods and services (the “Services”) sold between the Seller and the Buyer. They are intended to govern the relationship between the Seller and Buyers.

They can be accessed and printed at any time through a direct link at the bottom of the Site. The fact that Kinthia does not, at any given time, invoke any of these general terms of sale cannot be interpreted as a waiver of its right to invoke any of them later.

The invalidity of a contractual clause does not invalidate the general terms of sale. Kinthia’s temporary or permanent non-application of one or more clauses of the general terms of sale shall not constitute a waiver of the other clauses, which remain in effect.

The Site is in principle accessible to all internet users 24 hours a day, 7 days a week, except for interruptions, scheduled or not, by Kinthia or its service providers for maintenance and/or security purposes, in cases of force majeure, or for updates to the Site. Kinthia cannot be held liable for any damage of any kind resulting from the Site being unavailable.

Kinthia does not guarantee that the Site will be free of anomalies, errors or bugs, or that it will operate without failure or interruption. It may freely, and at its sole discretion, determine any period during which the Site or its content is unavailable. Nor can Kinthia be held liable for problems with data transmission, connection or network unavailability.

Article 1: Use of our online store

By accepting these Terms, you declare that you have reached the legal age of majority in your country or province of residence. You also consent to allowing any minor under your responsibility to use this site.
Any illegal use of our products or violation of applicable laws will result in the immediate termination of your access rights.

Article 2: General conditions

We reserve the right to refuse service to anyone for any reason at any time.
Your content (excluding banking information) may be transferred unencrypted over various networks. Credit card information, however, is always encrypted during transmission.

Article 3: Acceptance of the general terms

Acceptance of these general terms is shown by a checkbox in the registration, order or contact form. This acceptance can only be full and complete. Any acceptance with reservations is considered null and void. A User who does not agree to be bound by these general terms must not use the Services.

Article 4: Prices and product availability

Prices shown on the site may change without notice.
Because of frequent updates, some products shown as available may no longer be available at the time of purchase.

Article 5: Product descriptions

We do everything we can to describe our products accurately (images and text). However, we cannot guarantee that the colors displayed on your screen perfectly match those of the actual product.

Article 6: Orders

To place an order, the Buyer must select the product of their choice and add it to their cart.

They can view the summary of their cart at any time until the order is finally confirmed, and can correct any errors in the information entered.

The order is deemed received by Kinthia once it has been finally confirmed by the Buyer.

Kinthia recommends that the Buyer keep the information contained in the order confirmation.

Article 7: Shipping and returns

Delivery not received:
If your package is shown as delivered but you have not received it, we advise you to check with your neighbors or the carrier.
If the package is lost by the carrier, we will issue a refund or reship the order after investigation.

Refused delivery:
If delivery is refused, the return costs will be deducted from your refund. If the package cannot be returned or traced, a 25% fee will apply.

Defective or damaged products:
If the product has a defect (not related to the packaging), we will favor repair or exchange before offering a refund.

Change of address:
Any address error must be reported within 1 day of ordering. After that, Kinthia cannot be held responsible for any delivery problem.

Article 8: Right of withdrawal

The right of withdrawal is exercised as provided for by the French Consumer Code, or more broadly as set out below.

European Union:
• Consumer protection under national laws
• 30-day right of withdrawal

United Kingdom:
• Consumer Rights Act 2015
• 30-day right of return

United States:
• 30-day right of return
• Compliance with local consumer protection laws
• Alternative dispute resolution available

Return period

Our refund policy lasts 30 days from receipt of the package. After that, we unfortunately can’t offer a refund or exchange.

To be eligible for a return

• The item must be unused and in the same condition as when you received it.
• The item must be in its original packaging.

A proof of purchase or receipt is required for any return.

Please do not send your purchase back to the manufacturer.

Article 9: Legal warranties

The Seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery.
The consumer has 2 years from delivery of the goods to take action under the legal warranty of conformity.

In the event of a lack of conformity, the Customer may obtain repair or replacement of the product or, failing that, a refund.
The Customer does not have to prove the existence of the lack of conformity during the 24 months following delivery of the goods.

The legal warranty of conformity applies regardless of any commercial warranty that may be offered.

The Seller is also bound by the warranty against hidden defects in the product sold that make it unfit for its intended use, or that reduce that use so much that the buyer would not have bought it, or would have paid a lower price, had they known of them.

The Customer has 2 years from discovering the defect to take action.
In the event of a hidden defect, the Customer can choose between returning the product for a refund, or keeping the product and requesting a price reduction.

Please include your order number and a description of the problem.
The cost of returning a non-conforming or defective product is covered by the Seller under the legal warranties.

2. Warranty exclusions

The legal warranties do not cover:

• Damage resulting from misuse, negligence or lack of maintenance,
• Normal wear and tear from use,
• Unauthorized modifications to the product.

3. Reminder of consumer rights

Exercising the legal warranty of conformity or the warranty against hidden defects is free of charge for the Customer.
These warranties apply regardless of any commercial warranty that may be offered.

Article 10: Kinthia’s liability

Kinthia undertakes to carry out regular checks to verify that the Site is working and accessible. Accordingly, Kinthia reserves the right to temporarily interrupt access to the Site for maintenance. Likewise, Kinthia cannot be held liable for temporary difficulties or inability to access the Site caused by circumstances beyond its control, force majeure, or disruptions of telecommunication networks.

Kinthia provides the Buyer with no warranty as to the suitability of the Services for their needs, expectations or constraints.

Kinthia’s liability is excluded for any direct or indirect harm to property or persons suffered by the Buyer or a third party and resulting from the following cases:

• Negligence or fault by the Buyer or a third party,
• Any use under conditions clearly not compliant with the use of the Services.

Kinthia cannot be held liable for failure to perform, or delay in performing, sales contracts due to circumstances beyond its control or force majeure, it being expressly specified that the following are considered force majeure, in addition to those usually recognized by the case law of the courts of the Buyers’ countries:
exceptional weather, natural disasters, fires and floods, lightning, attacks, breakdowns or blockages of telecommunication networks, means of transport or postal services, including due to strikes, damage caused by viruses that the security tools available on the market cannot eradicate, and any legal, regulatory or public-order obligation imposed by the competent authorities that would substantially change these general terms.

In any event, any liability that Kinthia may incur under these terms is expressly limited to proven direct damage suffered by Buyers.

Article 12: Intellectual property rights

The systems, software, structures, infrastructure, databases and content of any kind (text, images, visuals, music, logos, trademarks, databases, etc.) used by Kinthia on the site are protected by all applicable intellectual property rights or database producers’ rights. Any disassembly, decompilation, decryption, extraction, reuse, copying and, more generally, any reproduction, representation, distribution or use of any of these elements, in whole or in part, without Kinthia’s authorization is strictly prohibited and may lead to legal action.

Article 13: Comments and reviews

By posting a comment on our site, you agree that we may use it for promotional purposes. Illegal, abusive or harmful comments may be removed at our discretion.

Article 14: Advertising services and partners

Kinthia uses online advertising services, including Google Ads, Meta Ads and Pinterest Ads, which may collect and process personal data in accordance with their own terms of use and privacy policies.

The use of these services is subject to the following conditions:

Users’ rights regarding advertising:
• EU/United Kingdom: right to withdraw consent to personalized advertising
• United States: right to opt out under applicable local laws
• All users: right to set advertising preferences through Google Ads Settings

Compliance with local requirements:
Our advertising practices comply with the legal requirements of each targeted region, including:
• GDPR and the ePrivacy Directive (EU)

Article 15: Advertising

Kinthia reserves the right to include advertising or promotional messages on any page of the site and in any communication to Users, in a form and under conditions that Kinthia alone will determine.

Article 16: Links and third-party sites

Kinthia cannot under any circumstances be held liable for the technical availability of websites or mobile apps operated by third parties (including any partners) that the User may access through the site.

Kinthia accepts no liability for the content, advertising, Services and/or services available on such third-party sites and mobile apps, which are governed by their own terms of use.

Article 17: Changes to the terms

We reserve the right to change these General Terms and Conditions of Sale at any time. Any update takes effect as soon as it is published on this page.

Users will be informed of these changes by any appropriate means.

Any User who uses the Services after the amended general terms come into force is deemed to have accepted these changes.

Article 18: Prohibited conduct

1. The following are strictly prohibited: (i) any conduct likely to interrupt, suspend, slow down or prevent the proper functioning of the Site, (ii) any intrusion or attempted intrusion into Kinthia’s systems, (iii) any misuse of the Site’s system resources, (iv) any action likely to place a disproportionate load on its infrastructure, (v) any breach of security and authentication measures, (vi) any act likely to harm the financial, commercial or moral rights and interests of Kinthia or the users of its Site, (vii) any practice that diverts the Site from the purposes for which it was designed and, finally, more generally, (viii) any breach of these general terms or of the laws and regulations in force.
2. It is also strictly prohibited to monetize, sell or license all or part of access to the Site, or to the information it contains.
3. In the event of a breach of any provision of this article or, more generally, of any violation of laws and regulations, Kinthia reserves the right to take any appropriate measures and to bring any legal action.

Article 19: Unsubscribing

The Buyer may unsubscribe from the Site at any time by sending a request to Kinthia by email, using the contact details given in Article 23.

Unsubscription takes effect within a maximum of 7 (seven) days from the request. It automatically deletes the Buyer’s Account.

Article 20: Languages

If these general terms are translated into one or more languages, French shall be the language of interpretation in the event of any contradiction or dispute over the meaning of a term or provision.

Article 21: Applicable law and jurisdiction

Arfooo, the company that operates Kinthia, is a French company. As such, French law and the French courts of its registered office apply by default to any dispute, unless otherwise provided by mandatory local consumer protection laws.

Kinthia directs its commercial activities to several countries through localized sites and specific advertising targeting. Therefore:

1. European Union consumers

• Applicable law: the mandatory consumer protection of your country of residence, supplemented by French law where there is no conflict.
• Competent jurisdiction: the courts of your country of residence or, at your choice, the French courts (the company’s registered office).
• Mediation: you can contact the mediator of your country of residence.
• Online dispute resolution platform: https://ec.europa.eu/consumers/odr/

2. UK consumers

• Applicable law: mandatory UK consumer protection laws (Consumer Rights Act 2015, Consumer Contracts Regulations 2013), supplemented by French law where there is no conflict.
• Competent jurisdiction: the courts of England, Wales or Scotland or, failing that, the French courts.
• Mediation: Ombudsman Services or any other approved UK alternative dispute resolution body.

3. US consumers

• Applicable law: mandatory federal consumer protection laws and the laws of your state of residence, supplemented by French law where there is no conflict.
• Competent jurisdiction: the courts of your state of residence for consumer claims, Kinthia also being able to bring matters before the French courts (registered office).
• Alternative dispute resolution: mediation or arbitration in accordance with local consumer regulations.
• Special rights: California residents have the data protection rights provided by the CCPA/CPRA.

General principle

In all cases, consumers benefit from the most favorable protections granted by their national legislation and French legislation.

Article 22: Entry into force

These general terms came into force on July 22, 2026.
